DECLARATION OF BOATING ACTIVITY EXEMPTION

Gippsland Ports as the declared waterway manager for the Local Port of Gippsland Lakes, makes the following declaration under section 203(3) of the Marine Safety Act 2010 (Vic).

For the purposes of boating activity conducted by the Paynesville Classic Boat Rally Inc, persons and vessels involved in the Paynesville Classic Boat Rally 2024 are exempt from the following requirements:

Waterway Rules made under the Marine Safety Act 2010 / Marine Act 1988

  1. Clause 2(h) of Schedule 104 – 5 knot speed restriction zone at the southern end of McMillian’s Strait, Paynesville

Subject to the conditions detailed below:

  • Participating vessels must operate at minimum practicable speed while inside the exclusion zone.
  • All persons on event official and rescue vessels involved with the event must wear a lifejacket at all times during the event and vessels must have all prescribed safety equipment.
  • The exemptions apply from 9:00am to 10:00am and 3:00pm to 4:00pm on Saturday 2 March 2024 and Sunday 3 March 2024 on the waters of Lake Victoria.
  • The exemptions apply provided the stated safety controls and undertakings detailed in the application form and associated documentation are adhered to.

Section 208(2)

NOTICE OF BOATING ACTIVITY EXCLUSION ZONE

Gippsland Ports as the declared waterway manager for the Local Port of Gippsland Lakes hereby gives notice under section 208(2) of the Marine Safety Act 2010 (Vic) that all persons and vessels not registered to take part in the Paynesville Classic Boat Rally 2024 are prohibited from entering and remaining in the following waters.

Waters of Lake Victoria – encompassing all waters inside the area delineated by a line extending from the westernmost point of the Paynesville Esplanade Boat Ramp western jetty, in a south westerly direction to the centre buoy marking the 5-knot zone at the Southern end of McMillian Straits to a point 40 metres due south of the buoy then extending in a north easterly direction to the easternmost point of the eastern Esplanade Boat Ramp jetty, bounded by yellow special mark buoys at approximate locations detailed below:

  • 37° 55.216′ S 147° 43.317′ E
  • 37° 55.217′ S 147° 43.330′ E
  • 37° 55.250′ S 147° 43.183′ E
  • 37° 55.267′ S 147° 43.183′ E

The exclusion zone will be in effect from 9:00am to 10:00am and 3:00pm to 4:00pm on Saturday 2 March 2024 and Sunday 3 March 2024.

The designated area will be marked with yellow special mark buoys to be deployed before 9.00am and removed by 5.00pm on the above dates.
